ken.adams@whatsameriga.it e
Malboro.
Dan.Crane@whatsameriga.it e
Belu.Mosi@whatsameriga.it).
Dear sir,
I am writing in response to your recent email regarding the sale or sharing of my personal data. This communication has raised serious concerns, particularly as I had previously requested the complete deletion of all my personal data from your databases, in line with the General Data Protection Regulation (GDPR), and had received confirmation of such deletion on 30th Jan 2024.
It has come to my attention that this communication violates Article 6(1)(a) of the General Data Protection Regulation (GDPR), which is in place to safeguard the privacy and rights of European citizens regarding the processing of personal data.
Article 6(1)(a) of the GDPR states that the processing of personal data is only lawful if the data subject has given consent to the processing of their personal data for specific purposes, such as receiving marketing communications.
As a responsible data subject, I want to clarify that I have not granted consent for any communication from your organization, nor have I shared my personal data with you. Thus, I must insist that you immediately cease sending unsolicited emails or processing my personal data without my explicit consent.
In light of this GDPR violation, I must inform you that any further unsolicited emails from your domain will be reported to the appropriate data protection authorities, including the "Die Bundesbeauftragte für den Datenschutz und die Informationsfreiheit" and “Commission Nationale de l'Informatique et des Libertés – CNIL”.
Under the GDPR, I exercised my right to be forgotten, which obligates your company to erase all my personal data from your records. The receipt of your recent email suggests a clear violation of this regulation and my personal rights.
I hereby reiterate my demand for the immediate and complete erasure of all my personal data from your databases, including but not limited to my name, professional profile, contact information, work history, education history, professional affiliations, and any links to my social media profiles. This request extends to any and all data shared with or sold to third parties, including Oracle Corporation.
Please consider this letter as a formal complaint under the GDPR. I expect a written confirmation of the following:
1. Confirmation that my personal data has been completely deleted from your records and any backups.
2. Confirmation that my personal data, which has been shared with or sold to third parties, has been recalled and deleted.
3. Detailed information on how my data was obtained and processed after my initial request for deletion.
Failure to comply with this request will leave me with no choice but to take further action, including filing a complaint with the appropriate data protection authority and seeking legal remedies.
I expect a prompt response to this letter, detailing the actions you have taken to address this grave matter.
